Membership

You may become a RoommateFinder member for no charge as long as you have an active phone number. You will be able to use all the features of RoommateFinder as selected by the community at which you plan to live. Certain features may or may not be available depending on the package and options selected by your community. We can never guarantee you will be, or remain content with, your roommate match (and room assignment).

Content / Prohibited Use

RoommateFinder provides you with a way to connect with other users living in the same community as you. You may not use the RoommateFinder system to:

1. promote hateful activities;
2. violate the Civil Rights Act of 1866, the Fair Housing Act, the Americans with Disabilities Act, Equal Credit Opportunity Act, or any other Local, State, National, and International Law;
3. post, upload, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;
4. violate the privacy of individuals;
5. post content containing viruses, Trojan horses, worms, time bombs, cancelbots, or other disabling devices or other harmful component intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
6. encourage any illegal activity;

RoommateFinder Inc. reserves the right to determine at its sole discretion your compliance with these terms. If you are found to be violating these terms, RoommateFinder Inc. will decide either to remove the content associated with the violation or terminate your membership.

By posting content to RoommateFinder, you agree that RoommateFinder may use or reproduce these materials without your prior approval with exception to the privacy policy outlined below. This includes user data or personal information.

By using RoommateFinder, you acknowledge that while RoommateFinder Inc. may screen and remove content, RoommateFinder Inc. is under no obligation to do so. You must also bear all risks associated with any content which you post.

Any individual who posts references to a competing company may be removed from the network at the sole discretion of RoommateFinder Inc.

RoommateFinder and RoommateFinder Inc. reserves the right at all times to disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.

Limitation of Liability

By using RoommateFinder, you agree to allow RoommateFinder Inc. to display any information provided to the RoommateFinder system to other users in the RoommateFinder system for the purposes of selecting a roommate and any other purposes deemed necessary by RoommateFinder Inc. RoommateFinder Inc. and your housing community are discharged from liability either in law or equity arising from or by reason of any bodily injuries known or unknown, death, harassment and/or property damage resulting or to result from the acts or omissions of any person you may select as your co-Resident (roommate). RoommateFinder Inc. is further discharged from liability either in law or equity arising from the use of the RoommateFinder system. I agree that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as permitted by the laws of the State of Illinois.

Roommate (and room) assignments are offered as a convenience to you, and your housing community assumes no liability for any claims relating in any way to roommate assignments. Your housing community applies the same rental criteria to all applicants, but unless otherwise indicated, does no investigation or background check beyond standard rental application processing. Unless otherwise indicated, your housing community makes no representations, guarantees or warranties of any type regarding the roommate assignment process, or any particular person who is assigned as your roommate. You voluntarily assume any risk in the roommate assignment process and hereby waive and release RoommateFinder Inc. and your housing community from any and all claims related to the roommate assignment process and/or the conduct of any roommates assigned to your apartment.

Your housing community will not make room assignments based on Race, Color, Religion, National Origin, Disability, Familial Status or Sexual Orientation in accordance with the Fair Housing Act. You authorize this information to be provided to potential roommates for the purpose of coordinating the roommate matching and move-in process.

Guidance from President Biden’s executive order 13988 issued on January 20, 2021 provides that sexual orientation is included in federally protected classes. Discrimination of any type is prohibited by the Federal Fair Housing Act (FHA).

RoommateFinder Inc. is a platform that facilitates connections between users seeking roommates based on shared preferences. While we strive to provide the best matches possible, we do not, and cannot, control the actions, behaviors, or suitability of users. Consequently, RoommateFinder Inc. is not responsible for the conduct, whether online or offline, of any user of our service. RoommateFinder Inc. assumes no responsibility or liability for any disputes, disagreements, or issues that may arise between matched roommates. All users are responsible for their interactions with other users of our service. We encourage you to take reasonable precautions when interacting with other users, especially when meeting in person. We cannot guarantee the compatibility, behavior, or actions of any roommate match.

Privacy

For each visitor to our Web page, our Web server automatically recognizes only the consumer’s domain name, but not the email address (where possible).

We collect only the domain name, the e-mail address of visitors to our Web page, aggregate information on what pages consumers access or visit, information volunteered by the user, such as a user’s phone number, survey information and/or site registrations.

The information we collect is used to improve the content of our Web page and to customize the content and/or layout of our page for each individual visitor. The information we collect will additionally be used to improve our proprietary roommate pairing algorithm.

We may share your information (including your email address and phone number) with our clients whose network you access as well as with any individual who is, was, or proposed to be in a room request with you.

With respect to cookies: We may set cookies for advertising or other purposes at our sole discretion.

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will post the policy changes to our Web site to notify you of these changes and we will use for these new purposes only data collected from the time of the policy change forward. If you are concerned about how your information is used, you should check back at our Web site periodically.

Upon request we provide site visitors with access to all information that we maintain about them.

Consumers can access this information by e-mailing or writing to us.
Consumers can have this information corrected by modifying their settings using the RoommateFinder system.

With respect to security: We have appropriate security measures in place in our physical facilities to protect against the loss, misuse or alteration of information that we have collected from you at our site.

Representation & Warranties

You represent and warrant that:

1. you have full right and power to enter into and perform these Terms of Use, and have secured all third party consents necessary to enter into these Terms of Use;
2. all factual assertions that you have made and will make to RoommateFinder are true and complete; and
3. you are of the age of majority or have parental consent, have the right to enter into legally binding agreements, and have the full and complete right to agree to the Terms of Use.

Governing Law, Jurisdiction, and Dispute Resolution

The Terms of Use shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of laws principles. You and RoommateFinder Inc. agree that any and all disputes arising out of or related to the Terms of Use shall be subject to the exclusive jurisdiction and venue of the state and federal courts located in Kendall County.

Changes To The Services & The Site

RoommateFinder Inc. reserves the right to change, suspend or discontinue any aspect of the services or the Sites at any time, including the availability of any features, databases or content. RoommateFinder Inc. will attempt to provide reasonable notice of such changes to the Services or the Sites. RoommateFinder Inc. may also impose limits on features or restrict access to parts of the Sites.

Modifications to the Terms of Use

RoommateFinder Inc. may amend these Terms of Use at any time by posting amended Terms of Use to the Sites. The amended Terms of Use shall be effective immediately upon posting to the Sites. RoommateFinder Inc. therefore encourages you to review these Terms of Use frequently.
